Appendix to file № 03 / 01. On 15 May 2026 the Committee of Ministers of the Council of Europe, meeting in Chișinău, adopted the agreement establishing the governing committee of the Special Tribunal for the Crime of Aggression against Ukraine. Thirty-six states and the European Union as an institution joined the agreement.

Exclusion
The statute bars indicting the sitting president, prime minister and foreign minister of the Russian Federation while they hold office.

Seat and model
Seat — The Hague; the Netherlands hosts the initial phase. Modelled on the Nuremberg Tribunal.
The European Union allocated €10 million for start-up (January 2026).

Status
States have joined the agreement on the governing committee. National ratification procedures are required before the tribunal can begin work.
Judges, prosecutor and rules of procedure are not yet approved. The governing committee meets at least once a year.
